Right of revocation You can revoke your contract within 14 days in written form (e.g. letter, fax, e-mail) without stating reasons or - if permission to use the goods prior to expiry of the fixed term was granted to you - by returning the goods. The withdrawal period starts when this information is received in writing, but not before the goods have been delivered to the Customer (where similar goods are delivered on a recurring basis, then not before receipt of the first part delivery) and not before we have fulfilled our obligations to provide information as defined in Article 246 section 2 in conjunction with section 1 sentence 1 and 2 of the EGBGB (Introductory Law to the German Civil Code) as well as our obligations according to section 312g Paragraph 1 sentence 1 of the BGB (German Civil Code) in conjunction with article 246 section 3 of the EGBGB.

The timely despatch of the revocation or the goods shall be deemed sufficient for compliance with the revocation term.

Excluded from return are, according to section 312d paragraph 4 number 1 und 2 BGB, goods which were are manufactured to customer specifications or which by their nature are not suitable for return shipment, such as downloads of ebooks, video and audio files.

Consequences of revocation
In the case of an effective revocation, the payments or goods received by both parties are to be restored and, if necessary, any profit drawn (e.g. interest) surrendered. If you are unable to return the received benefits in their entirety or partially or only in worse or diminished condition, you may have to reimburse us for the value of the benefit. For the deterioration of goods and for uses made thereof, the Customer must only provide value replacement, provided that the uses or the deterioration goes beyond dealing with the goods to check the features and the functions. Under “checking of features and functions” is to be understood testing and trying out the product in question as would be possible and normal practice in a physical shop.

Goods consignable by parcel shipment may be returned at our risk. The Customer is responsible for covering the regular cost of return postage if the goods delivered are as ordered and if the price of the goods to be returned is less than € 40, or in case of a higher price you have not provided consideration or a partial payment agreed under the terms of the contract. Otherwise, the return is free of charge for the Customer. Goods not consignable by parcel shipment shall be collected from the Customer. Duties for the compensation of payments must be fulfilled within 30 days. For the Custoer, the period begins on submission of the declaration of withdrawal or return of the goods and for us upon receipt of the same.

Premature expiration of the right of termination
The right of cancellation expires prematurely in the case of contracts for delivering sound or video recordings or computer software in sealed packaging if the packaging is removed after delivery.
